1. GENERAL TERMS AND CONDITIONS

www.kameraliike.fi is a marketplace maintained by Mikkelin Valokuvausliike Oy, where the seller of the goods is either Mikkelin Valokuvausliike Oy, Mikkeli (Business ID: 0165019-5) or a third party separately mentioned in the product description. Mikkelin Valokuvausliike Oy also maintains and is responsible for the Mikkeli store. The following terms and conditions apply to the commercial relationship between Mikkelin Valokuvausliike Oy and its customers. In addition to the Consumer Protection Act, the terms and conditions specified by the service provider in question apply to third-party goods provided by Mikkelin Valokuvausliike Oy.

Mikkelin Valokuvausliike Oy reserves the right to change these terms and conditions by unilateral decision without prior notice. Orders are subject to the terms and conditions in force at the time of order, which are displayed on Mikkelin Valokuvausliike Oy's website. Changes in the law enter into force immediately as they are, unless otherwise provided by law.

Mikkelin Valokuvausliike Oy is not liable for damage caused by force majeure. Force majeure is considered to be an unforeseen circumstance or change in circumstances that is beyond the control of Mikkelin Valokuvausliike Oy and which Mikkelin Valokuvausliike Oy cannot reasonably overcome. Mikkelin Valokuvausliike Oy is obliged to notify the customer as soon as possible of the force majeure that has occurred.

2. Ordering

Mikkelin Valokuvausliike Oy sells products and services to private individuals of full age (hereinafter referred to as consumers) and, with the consent of a guardian, also to those under the age of 18. Goods are also sold to corporate, public administration and community customers (hereinafter referred to as corporate customers) who purchase merchandise for professional use in Finland.

In consumer trade, the current Finnish and European Union consumer protection legislation is followed. These terms and conditions are not valid to the extent that they restrict the consumer's rights from what is stipulated in mandatory legislation.

The Finnish Commercial Code applies to sales contracts between corporate customers and Mikkelin Valokuvausliike Oy, unless otherwise specified in these terms and conditions.

When placing an order, the customer is obliged to provide their complete contact information, which includes at least the name, address and telephone number and possibly an email address for consumer customers. The information required for business customers is the name, telephone number and email address of the contact person as well as the business ID, postal address, telephone number and, if necessary, the billing address.

Products are mainly ordered online at www.kameraliike.fi via the shopping cart.

All orders are confirmed by email, which includes the price of the order, shipping costs and the products ordered. To receive an order confirmation, you must provide your email address when placing your order.

The customer agrees to the delivery terms and conditions in force with each order.

3. Delivery time

Delivery time estimates (given in weekdays) have been prepared based on information provided by importers and manufacturers. Mikkelin Valokuvausliike Oy or its suppliers are not responsible for delays caused by unforeseen changes outside their sphere of influence. A binding sales contract enters into force when the order is registered in Mikkelin Valokuvausliike Oy's system.

We ship products to the address provided every weekday. In case of exceptional deliveries, please contact Mikkelin Valokuvausliike Oy customer service immediately.

Stock status and delivery time indicated on the product card

  1. Immediate delivery (In stock X) = The product is immediately in stock. We aim to deliver orders placed before 3:30 PM on the same business day.
  2. Delivery XX days (Importer X) = The product is a custom-made product that we are waiting for to arrive from the importer. The delivery time range is an estimated time in weekdays.
  3. Out of stock (In stock 0) = The product is not in our warehouse or the importer's warehouse.

4. Products and prices

Prices include VAT, but do not include shipping unless otherwise stated. If there are obvious price errors in the price list, the product will not be sold at a clearly lower price if it can be assumed that the customer understood the existence of the error.

If the price of a product increases before the shipment is processed, products ordered at Mikkelin Valokuvausliike Oy will be delivered at the original price. If changes are made to the order, the price of the product will be determined according to the price at the time of the change.

Mikkelin Valokuvausliike Oy reserves the right to limit the sale of products in exceptionally large quantities. Mikkelin Valokuvausliike Oy does not sell its products for resale.

The age limits of the products are complied with as prescribed by law. Ordering K-18 products requires providing your date of birth to Mikkelin Valokuvausliike Oy.

Products manufactured, ordered or modified at the customer's request are not subject to a unilateral right of cancellation. In the event of cancellation, any costs incurred in connection with the order will be charged in full to the buyer.

Professional products are sold to consumers only under the rules of business transactions. The installation, commissioning and use of the products require professional expertise in their field.

Products and services are always sold as is. This refers to the sale of used discounted products. (Consumer Protection Act, Chapter 5, Section 14)

5. Delivery method and delivery costs

Products can be picked up from our store without delivery costs.

The costs for delivery are as follows:

Matkahuolto Nearby package

Pickup from a Matkahuolto service point: Delivery to a Matkahuolto pickup point of your choice, such as a parcel machine, Matkahuolto, K-Market or R-kiosk, usually within 1-2 working days, in larger cities also on Saturdays. You will be notified as soon as your package is available for pickup.

Matkahuolto Home Delivery Package

Matkahuolto delivery to your door at an agreed time: Delivery to your door at an agreed time, also in the evenings and on Saturdays. You will receive a notification of the arriving package via text message to agree on a delivery time. With the recipient's permission, the delivery can also be left at the recipient's door without acknowledgement.

Delivery Mon-Sat by 7 pm. You will receive a message when the package is available for pickup from the machine.

Posti Express to your workplace or home

Posti Express package. Posti will deliver your order to your desired address by 4 p.m. Mon-Fri, without separate notification.

Mail delivery to home

Posti delivery to the recipient's door at a time agreed with the customer. Deliveries are made on weekdays. Agreed delivery times vary by region between 9 am and 9 pm.

Cash on delivery

With cash on delivery, you pay for your order at a Posti pickup point when you pick up the package. We charge an additional fee of 4 EUR for cash on delivery.

7. Payment methods

Products and their shipping costs are paid for when ordering.

The following payment methods can be used in the online store:

Online banking: Nordea, Osuuspankki, Danskebank, Tapiola, Aktia, Nooa, Local cooperative banks, Savings banks, Handelsbanken, S-Pankki, Ålandsbanken and credit cards. Payment is made via the Paytrail Oyj website.

The payment intermediary service related to online banking payments is implemented by Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. From the user's perspective, the service works just like traditional online payments.

E-invoice for public administration (municipalities, cities, educational institutions). For other companies, the shipment will be delivered once the payment has been received.

8. Exchange and return conditions

For unused mail order products, there is a 30-day right of return, which is longer than the 14 days stipulated in Chapter 6 of the Consumer Protection Act. The purpose of the law is to give the consumer the right to familiarize themselves with the product as it is possible in a store.

Mikkelin Valokuvausliike Oy grants the customer, in accordance with the spirit of the law, the right to familiarize themselves with the product and try it out in the same way as they would when purchasing the goods from a store. The customer can also open the packaging to examine the goods without losing their right of withdrawal. However, the customer cannot use the goods, for example by using a digital camera for photography, flying or activating a photography drone, etc.

The product packaging should be opened carefully and neatly and all its parts should be retained. The right of return only applies to unused and saleable products, for example, opened software (also applies to software supplied with cameras), plastic packaging (for example, memory cards) or special order products are not eligible for return.

Restrictions on the right to return in accordance with Chapter 6, Section 16 of the Consumer Protection Act:

  1. Games, movies, software (including software discs that came with the camera package) or other sealed products such as memory cards, etc. are not eligible for return once the product packaging has been opened.
  2. Installing the computer operating system ends the right to return.
  3. The product is not eligible for a right of return and/or cancellation if it is a product specifically manufactured, ordered or modified at the buyer's request, once the work has begun or the purchase order for the product purchased specifically for the customer has been completed.

Customer returns and service deliveries should always be sent by post using the free customer return service or brought to our store. In the event of a return, please first contact our sales department at tel. 015-211 540 or by email at asiakaspalvelut@kameraliike.fi.

The delivery method must be a parcel, as there is no tracking for letters. A free-form note must be provided with the return or service delivery, including your contact information and the reason for the return.

The customer is obliged to keep the necessary copies of the return documents. The parcel tracking number obtained from Posti's customer return is the only means of proving the sending.

Mikkelin Valokuvausliike Oy's free customer returns are only valid in Finland. The customer must pay all costs for returns and service deliveries sent from abroad. The customer must contact Mikkelin Valokuvausliike Oy's customer service before returning/service deliveries abroad.

Packaging is the responsibility of the sender. Products must be packaged carefully to prevent damage during transport. Products must be padded with at least 10 cm of padding. Mikkelin Fotografiausliike recommends always using the product's original packaging, which the manufacturer has designed for safe transport.

Mikkelin Valokuvausliike Oy is not responsible for damage to returns that are packaged carelessly and in violation of the terms of the contract. Costs incurred due to an error on the part of the customer will be charged to the customer.

Mikkelin Valokuvausliike Oy reserves the right to charge the customer for the costs if the customer return has been made without reason or in violation of the terms of the contract. The customer will be charged Mikkelin Valokuvausliike Oy's handling and mailing costs.

Mikkelin Valokuvausliike Oy does not accept cash on delivery returns.

Mikkelin Valokuvausliike Oy grants a limited 30-day right of return for normal stock products ordered by corporate customers. The returned product must be unused and in its unopened sales packaging. The product can be returned either directly to the store or as a customer return. For more information about returns, please contact asiakaspalautus@kameraliike.fi. The right of return does not apply to products specially customized for the customer. In addition, in the case of a maintenance extension or other separate service ordered for the customer, the corporate customer does not have the right to cancel the order once the order has been logged into Mikkelin Valokuvausliike's system.

We do not accept returns more than 30 days after delivery. Once the return is approved, the money will be refunded directly to your account after the return is received and processed, minus any cancellation fees or damages.

If the package is not picked up from Posti or Matkahuolto, we will not issue automatic refunds. For unpicked orders, we will charge at least the costs incurred by us for delivery and return.

In the event of a return, please first contact our sales department at tel. 015211540 or by email at asiakaspalvelut@kameraliike.fi. Returns will not be accepted by cash on delivery, and the costs incurred by the return will not be reimbursed unless the return has been agreed upon with the seller first.

9. Problems with transportation and defective products

If the product is lost during transport, damaged or the wrong product has been delivered to the customer, the customer must report the error immediately to asiakaspalvelut@kameraliike.fi, by phone 015-211540 or by mail:

Notification of incorrect delivery or defective product must be made within 30 days of receipt of the product. If the package is damaged in the mail, a complaint about the product must be made to the post office immediately.

10. Warranty and liability for defects

The warranty is determined in accordance with the warranty terms specified by the manufacturer. This also applies to additional warranties granted by Mikkelin Valokuvausliike Oy or the importer. The buyer is obliged to familiarize himself with the warranty terms supplied with the product before using the product. The warranty terms can be found in the user manual, a separate warranty form or on the website provided by the manufacturer.

Mikkelin Valokuvausliike Oy reserves the right to verify any errors reported in the products. Testing is not performed while waiting. Please allow 3-5 business days for this.

The service location is determined in accordance with the manufacturer's or importer's warranty terms. Mikkelin Valokuvausliike Oy directs its customers to contact the manufacturer or its authorized service center directly if this can be considered to be of benefit to the customer. The consumer also has the option of delivering the product through Mikkelin Valokuvausliike Oy for service. Mikkelin Valokuvausliike Oy believes that when delivering the product through our service center for repair, the service time will be longer by the time spent on logistics.

The estimated service time for the service process in Finland is 10-15 business days. Some of the products sold at Mikkelin Valokuvausliike Oy have to be delivered abroad for service because there is no manufacturer-authorized service in Finland. In this case, the estimated service process is 10-20 business days.

The costs of an unjustified service visit are charged in full to the buyer if the product has been submitted for warranty service without a clear reason. Mikkelin Valokuvausliike is not liable for any damage caused by the buyer's actions. Mikkelin Valokuvausliike Oy retains the right to inspect the nature and quality of the defect in the product even in the event of cancellation of the transaction. The costs of unjustified service include any costs incurred by the service company, Mikkelin Valokuvausliike Oy's handling costs and logistical costs.

A fee according to the price list will be charged for troubleshooting equipment assembled by the buyer or a third party, if the error is not in a component supplied by Mikkelin Valokuvausliike Oy. A compatibility problem is not considered an error unless the customer has explicitly and provably notified Mikkelin Valokuvausliike Oy of the need for compatibility at the time of purchase. The acquisition, installation and use of computer components require expertise comparable to that of a computer installer.

Physically opening the product to modify the device terminates the warranty and statutory liability for defects unless otherwise stated by the manufacturer.

Mikkelin Valokuvausliike Oy will store the products for three (3) months after the customer has been notified of the completion of the maintenance/work. After this, the product will be recycled. (Act on the Right of a Business Operator to Sell an Unclaimed Item)

Liability for digital recordings is always determined according to the risk. Mikkelin Valokuvausliike Oy is not liable for data or software stored on digital media when the risk lies with the customer. Backups are the buyer's responsibility. Backups must always be performed before the maintenance process. Rescuing files from a damaged device is an additional service for a fee.

11. Complaints

The customer is obliged to present a proof of purchase, receipt or other proof of the place and time of purchase when returning or complaining about a defect in the goods. Mikkelin Valokuvausliike Oy reserves the right to charge the buyer for the costs incurred in finding the receipt.

Complaints are only processed in writing. A free-form complaint can be submitted either by email to asiakaspalvelu@kameraliike.fi or by letter to Mikkelin Valokuvausliike Oy, Porrassalmenkatu 21, 50100 Mikkeli.

Dispute resolution and place of jurisdiction: The consumer customer has the right to submit any disputes arising from this agreement to the Consumer Disputes Board. The customer may bring an action against Mikkelin Valokuvausliike Oy regarding disputes arising from this debt relationship either in the district court of Mikkelin Valokuvausliike Oy's domicile or in the district court of the place in Finland in whose jurisdiction he or she has his or her place of residence. If the customer does not have a place of residence in Finland, the disputes will be handled in the district court of Mikkelin Valokuvausliike Oy's domicile.

Attorney fees are not reimbursed because the Consumer Advice and Consumer Disputes Board offers free assistance in resolving disputes.

12. Distribution of liability in a business transaction

Products and services are always sold as is. Mikkelin Valokuvausliike Oy is not liable for any indirect or direct costs or loss of income caused by defects and/or use of products or services. Mikkelin Valokuvausliike Oy's liability for compensation is always limited to the content of these terms and conditions. Product defect liability is limited to the possible return of the purchase price less the useful life.

The warranty period for a device purchased for business use is determined in accordance with the manufacturer's warranty terms, and the expiration of the warranty period terminates Mikkelin Valokuvausliike Oyj's liability. Physically opening the product to modify the device terminates the warranty and the seller's liability unless the manufacturer has stated otherwise.

Mikkelin Valokuvausliike Oy reserves the right to direct business customers to deal directly with the manufacturer or a service center authorized by the manufacturer. For more information about maintenance, please contact Mikkelin Valokuvausliike Oy's customer service.

Data and software stored on digital media are the responsibility of the end user. The customer is responsible for maintaining backups. Recovering files after product failure is an additional service for a fee.

Mikkelin Valokuvausliike Oy will store the products for three (3) months after the customer has been notified of the completion of the maintenance/work. After this, the product will be recycled.

Mikkelin Valokuvausliike Oy is not obliged to fulfill the contract if it encounters a force majeure event that it cannot reasonably overcome. Mikkelin Valokuvausliike Oy is not obliged to compensate the customer for any damage or costs incurred by the customer in the event of a force majeure event, and is entitled to terminate the contract.

By placing an order and/or a request for quotation, the customer unconditionally accepts the terms and conditions of Mikkelin Valokuvausliike Oy. Any terms and conditions of purchase used by the customer will not be followed if they conflict with the terms and conditions of Mikkelin Valokuvausliike Oy.

13. Services

Mikkelin Valokuvausliike Oy offers its customers services that are separately defined in the price list. The service agreement is fully subject to Mikkelin Valokuvausliike Oyj's terms and conditions.

There is no right of cancellation or refund for service orders. All costs incurred for work that has already begun will be invoiced if the order is cancelled by the customer after the electronic order confirmation has been sent. The work will be suspended without delay after the customer has notified the company.

The order is paid for in accordance with Mikkelin Valokuvausliike Oy's payment terms. All rights to the customer's material are reserved until the order price has been paid in full. If the material provided by the customer is used by a third party, the right of lien and retention also applies to this material, which the customer is obliged to notify the third party of before the material is transferred to Mikkelin Valokuvausliike Oy.

Mikkelin Valokuvausliike Oy has the right, in addition to the agreed price, to invoice the customer for costs arising from changes in the situation or other circumstances on the customer's part. Such changes include incompleteness of the delivered material, corrections and changes to the agreed material after the work has started, unreasonable delay caused by the customer, additional proofs, print or color samples. The customer is responsible for any additional freight and packaging costs.

If there is reason to invoice the above-mentioned additional costs, Mikkelin Valokuvausliike Oy will inform the customer of this without undue delay.

An order is not considered to contain an error if the error is due to an error in the original material, unless the correction of the error has been clearly agreed upon in writing when checking the proof. In the case of error correction subject to interpretation, the responsibility lies with the customer.

Mikkelin Valokuvausliike Oy reserves the right to correct the error. Based on the nature and quality of the error, the error assessed will be corrected by granting a reasonable price reduction or by delivering a new product. The amount of compensation resulting from the error is a maximum of the order price. Mikkelin Valokuvausliike Oy is not liable for direct or indirect damages or loss of earnings resulting from the error.

Mikkelin Valokuvausliike Oy will store the finished product with due care after the agreed delivery date. Mikkelin Valokuvausliike Oy has the right to charge the customer for reasonable costs incurred in storage. The product will be stored for a maximum of three (3) months, after which the product will become the property of Mikkelin Valokuvausliike Oy. Mikkelin Valokuvausliike Oy reserves the right to sell the uncollected product in any way it deems best. If the product has no resale value or if the sale would result in unreasonable costs, Mikkelin Valokuvausliike Oy reserves the right to dispose of the product by recycling. All manufacturing, storage, sales and/or recycling costs will be invoiced directly to the customer.

The customer guarantees that the original material or other material provided does not infringe the copyright and/or industrial property rights of a third party, and that the material is not subject to any usage or other legal restrictions or obligations. This also applies to other intangible exclusive rights. The customer is obliged to compensate Mikkelin Valokuvausliike Oy for all costs and compensations incurred by it as a result of third party claims.

14. Change

We reserve the right to change our delivery terms. The customer must familiarize themselves with the current delivery terms before placing an order.

Mikkelin Valokuvausliike Oy processes all customer information in complete confidentiality.

Mikkelin Valokuvausliike Oy undertakes not to disclose customer information to third parties.
